Terms of Service

Parties

This Agreement (“Agreement”) is entered into between Wheelchairs for Rent (“Company”) and the undersigned Client (“Renter”) as of the date of rental.

Equipment

The Company agrees to rent to the Renter the following equipment: mobility equipment (“Equipment”). All Equipment remains the property of Wheelchairs for Rent.

Rental Term

The rental term begins on the delivery date and continues for the duration agreed upon. Extensions may be arranged with advance notice and additional payment.

Payment

Payment must be submitted prior to delivery. Equipment must be returned in good, clean condition, normal wear and tear excepted. Payment may be made by available payment methods as decided by the Company.

Replacement, Damage, & Incidental Costs

The Renter is responsible for any loss, theft, or damage beyond normal wear. If Equipment is not returned upon the agreed up end date, or is lost, stolen, or deemed non-functional upon return, the Renter authorizes a $300 replacement fee to be charged. Any repair or cleaning fees will be charged to the card on file.

Card Authorization

The Renter authorizes DC Wheelchair Rentals to charge the card on file for:

  • Rental extensions
  • Replacement costs
  • Cleaning or repair costs beyond normal use
  • Other charges as agreed upon between the Company and Renter
  • Any unpaid balances or incidental fees incurred during or after the rental period. 

This authorization remains valid until all amounts due under this Agreement are paid in full.

Care & Use

The Renter agrees to:

  • Use the Equipment safely and for its intended purpose only
  • Not alter, repair, or modify the Equipment
  • Keep the Equipment clean and protected from weather when not in use
  • Contact the Company if they encounter any equipment or other issues.

Liability Waiver & Release

The Renter acknowledges that wheelchair use involves inherent risks and agrees to assume all responsibility for injuries or damages resulting from its use.

The Renter hereby releases and holds harmless DC Wheelchair Rentals, its owners, agents, and employees from any and all claims, liabilities, damages, losses, or expenses (including attorney’s fees) arising out of or related to:

  • The use or misuse of the Equipment
  • Any bodily injury, property damage, or other harm, whether caused by negligence or otherwise
  • This release shall apply to the Renter, the Renter’s family members, guests, and any other persons using the Equipment

Indemnification

The Renter agrees to indemnify and defend the Company from any claims or costs arising from improper use or unauthorized third-party use of the Equipment.

Return of Equipment

The Renter must make the Equipment available for pickup on the agreed return date in substantially the same condition as delivered. Late returns may result in additional charges.

Entire Agreement

This Agreement constitutes the entire understanding between the parties. No verbal representations or modifications are binding unless made in writing and signed by both parties.

Governing Law

This Agreement shall be governed by the laws of the District of Columbia.
